CONDITIONS OF PARTICIPATION - DFB-Pokal Challenge

I. Competition

The organizer of the competition 'DFB-Pokal Challenge' is Kickbase GmbH, Pariser Straße 25, 81667 Munich, Germany.

Participation in this competition is governed exclusively by these conditions of participation. By participating, the participant accepts these conditions of participation.

II. Procedure

The Organizer organizes a competition in the winning period (DFB-Pokal season 2024/2025).
The competition, in which participants can win a season prize, extends over all rounds of the DFB-Pokal. The period of the competition is as follows:

Start: 1st round of the DFB-Pokal (16.08.2024, 18:00)
End: 6th round (final) of the DFB-Pokal (24.05.2025, 23:00)

In order to participate in the competition, the participant(s) must have taken the participation action described under III. Before the start of the first match on the respective round, whereby the official match schedule of the DFB-Pokal (available at https://www.dfb.de/dfb-pokal/spieltag/) shall be decisive for determining the time.

III. Participation

In order to participate in the competition, the participant must have registered as a user in the Kickbase app ("Kickbase account"). Within the Kickbase app, he/she can join the challenge "DFB-Pokal Challenge" and participate in the competition. Specifically, to do so, he must field a team consisting of eleven real players without exceeding the specified virtual budget of EUR 200 million. Participation is only possible until the kick-off of each round of the DFB-Pokal (hereinafter referred to as the "Entry Deadline"). Line-ups submitted after the closing date and those that exceed the specified budget will not be taken into account in the evaluation. For the competition, the evaluation will be based on the three match days with the highest number of points, which will be added to a total number of points.

Each participant may only take part with one Kickbase account. Creating additional accounts with the intention of entering them in the competition is not allowed. Should the organizer determine that several accounts are participating in the competition via one end device, he/she may disqualify all accounts concerned without giving further reasons.

Participation in the competition is free of charge - with the exception of the transmission costs incurred according to the tariff of the respective mobile phone or Internet provider selected by the participant - and is not dependent on the purchase of goods or services. Subsequent costs may be incurred for claiming a prize (see under VI.).

IV. Eligible participants

Natural people who are resident in Germany, Austria or Switzerland, have reached the age of 18 and have a Kickbase account are eligible to participate. Participation is not limited to existing customers of the organizer, i.e. participants can also be persons who only create a Kickbase account after the start of the competition. To participate in the competition, participants must take part in the "DFB-Pokal Challenge" challenge on at least five match days.

If a participant has limited legal capacity, he/she requires the consent of his/her legal representative to participate.

All persons involved in the conception and implementation of the competition and employees of the organizer, as well as their family members are not eligible to participate in the competition. In addition, the organizer reserves the right, at its own discretion, to exclude persons from participation if there are justified reasons. Justified reasons include, in particular, (a) manipulation in connection with access to or implementation of the competition, (b) violations of these conditions of participation, (c) unfair practices or (d) false or misleading information in connection with participation in the competition.

V. Exclusion from the competition

In the event of a breach of these conditions of participation, the organizer reserves the right to exclude the persons concerned from the competition - also with retroactive effect. The same applies if persons provide untrue information about themselves.

Persons who use unauthorized aids or otherwise obtain advantages through manipulation may be excluded from the competition retroactively. In such cases, the organizer may also retroactively disqualify and reclaim winnings. 

VI. Winning, notification and transmission of the prize

Season prize (competition)
For the DFB-Pokal season 2024/2025, the winners of the following season prize will be determined from among all participants:

1st place: 10.000 Euro

The season prize will only be awarded once depending on the ranking, i.e. only to one person at a time. The winner of the season prize will be determined two days after the DFB-Pokal final, i.e. on 26.05.2025, as part of the final points settlement within the Kickbase app. For this purpose, the five match days with the highest number of points of each participant will be added to a total number of points. The participant with the highest score wins the 1st place of the season prize. If two participants have the same score, the participant with the lower team score, i.e. the one who needed less budget for the formation of his/her team, will be placed better. If both or more participants have the same score as well as the same team value, the winner will be determined by drawing lots in accordance with the random principle. Legal recourse is excluded in this respect.

The winner will be notified of the prize in a timely manner by e-mail to the e-mail address provided during registration of the Kickbase account.

The cash prize will be handed over by bank transfer. An exchange, a transfer as well as a cash payment of the winnings are excluded.

The winner is responsible for any taxation of the prize. 

If the winner does not report after two requests by the organizer within a total period of three weeks under communication of the following data

  • First and last name 
  • Postal address, if the prize is to be delivered by post
  • Confirmation that the winner has reached the age of 18,

the organizer may award the prize to the next placed participant.

VII. Premature termination of the competition

The organizer expressly reserves the right to cancel or prematurely terminate the competition without prior notice and without giving reasons. The organizer will make use of this option in particular if there are reasons that would disrupt or prevent the scheduled course of the competition or if a proper execution of the competition cannot be guaranteed for technical (e.g. viruses in the computer system, manipulation or errors in the hardware and/or software) or legal reasons.

VIII. Facebook Disclaimer

This competition is not affiliated with Facebook and is in no way sponsored, endorsed or organized by Facebook. Each entrant fully releases Facebook from any claims arising from participation in the competition.

IX. Data protection

1. Responsibility for data collection and processing

The organizer collects and processes your data as the responsible party within the meaning of the DSGVO.

2. Processed data and purpose of processing

The organizer collects and processes your data exclusively for the purpose of the proper handling and implementation of the competition, including the sending of the prizes.

To fulfill this purpose, we process the following personal data:

First and last name 

Age of majority yes/no,

Contact details (username, e-mail address, postal address)

The processing of this data for the above-mentioned purpose is necessary for the fulfillment of the competition relationship with you and is carried out on the legal basis of Art. 6 (1) lit. b DSGVO. Without this data, we cannot carry out the competition and send the prizes. The organizer points out that all personal data of the participant will neither be passed on to third parties nor given to them for use without consent.

3. Publication

In the event of a win, the winner agrees to the publication of his/her name, Kickbase username and Kickbase profile picture in the advertising media used by the organizer, Art. 6 para. 1 lit. a DSGVO. This expressly includes the announcement of the winner on the website of the operator and its social media platforms (Facebook, Instagram, YouTube, Twitter). The winner may revoke his consent at any time. The revocation must be sent in writing to the e-mail address hello@kickbase.com.

4. Data transfer

Except for the fulfillment of the aforementioned purposes (including the sending of the prize by mail), no data will be passed on to third parties.

5. Duration of data storage

The organizer stores the data collected in the context of the competition only as long as they are required to fulfill the purpose for which they were collected. After the end of the competition and the sending of the prizes, the organizer deletes the data in principle after 14 days, as long as they are not required beyond that for the prize notification or the organizer is obliged to store them for a longer period due to legal provisions and/or official or judicial orders.

6. Data subject rights

Data subjects may request information about what data is stored about them (Art. 15 DSGVO). They can demand correction (Art. 16 DSGVO), deletion (Art. 17 DSGVO) and restriction of processing (Art. 18 DSGVO) of their personal data, as long as this is legally permissible and possible within the framework of an existing contractual relationship.

Data subjects also have the right to lodge a complaint with a supervisory authority. The supervisory authority responsible for the organizer is: Bayerisches Landesamt für Datenschutzaufsicht (BayLDA), Promenade 18, 91522 Ansbach.

You have the right to portability of those data that you have provided to the organizer on the basis of consent or a contract (data portability, Art. 20 DSGVO).

If you have given the organizer consent for data processing, you may revoke this consent at any time by the same means by which you gave it. The revocation of consent does not affect the lawfulness of the processing carried out on the basis of the consent until the revocation (Art. 7 (3) DSGVO).

You may object to data processing on grounds relating to your particular situation if the data processing is carried out on the basis of our legitimate interests or is necessary for the performance of a public task (Art. 21 DSGVO). X. Liability

The organizer is released from all obligations with the dispatch of the prize, unless an earlier point in time results from these regulations.

The organizer is not liable for material and/or legal defects of the prizes.

The organizer is not liable for the insolvency of a cooperation partner as well as the consequences resulting from this for the implementation and processing of the prize game.

The organizer shall be liable - irrespective of the legal grounds - within the scope of fault liability in the event of intent and gross negligence. In the event of simple negligence, the organizer shall be liable, subject to statutory limitations of liability (e.g. due diligence in its own affairs; insignificant breach of duty), only (i) for damages arising from injury to life, limb or health, (ii) for damages arising from the breach of a cardinal duty (i.e. an obligation the fulfillment of which makes the proper performance of the competition possible in the first place and on the fulfillment of which the participants may regularly rely and trust); in this case, however, liability shall be limited to compensation for the foreseeable, typically occurring damage.

The competition of the operator is subject exclusively to the laws of the Federal Republic of Germany. The legal process is excluded.

If any provision of these Terms and Conditions of Participation is or becomes invalid in whole or in part, this shall not affect the validity of the rest of these Terms and Conditions of Participation. Instead of the invalid provision, the legally permissible provision that comes closest in economic terms to the meaning and purpose expressed in the invalid provision shall apply. The same shall apply in the event of a loophole in these Terms and Conditions of Participation.
